General product disclaimers – Matters of Consumer Goods Guarantees
Directive 99/44/EC of the European Parliament and of the Council of 25 May 1999 concerning certain aspects of the sale and guarantees of consumer goods.
The directive concerns the statutory guarantee and the commercial guarantees .
The concept of legal guarantee concerns the legal protection of the buyer against defects in the purchased products. This legal protection has been made mandatory by law and does not depend on the contract. The directive thus establishes the principle of product compliance with the terms of the contract. By way of example, we refer to the right of the buyer to demand repair, replacement of the product, reduction of the price or to withdraw from the contract, requesting a refund, due to an actual defect of the product or lack of agreed quality for a period of two (2) years from the date of delivery.
The concept of commercial warranty, on the contrary, it presupposes the manifestation of the will of a person, the guarantor, who makes himself responsible for certain defects. The consumer has the right to request a repair if during the warranty a product shows a real defect as well as a temporary replacement of the product for as long as its repair lasts, in case the required repair time for the product under warranty exceeds 15 working days.
The directive does not use the terminology of legal and commercial guarantee. When the term “warranty” is used, it covers only the commercial guarantees defined as follows: “any undertaking by the seller or manufacturer to the consumer, without additional charge, to refund the price paid, replace, repair or take care of any way of the good in the event that the consumer good does not meet the characteristics mentioned in the warranty statement or the relevant advertisement”.
A consumer good is any tangible movable thing, except: goods sold in execution or otherwise by judicial authority, water and natural gas when not packaged for sale in a limited volume or specified quantity and electricity .
All products purchased from us through the respective representatives for the Greek and European market have a guarantee – support from the respective importer – distributor. Right of withdrawal:
From the initial submission of the customer’s order up to a deadline of 14 calendar days from the date of conclusion of the service contract (in the case of such a contract), or from delivery (in the case of products) and in fact when there are several in the same order from the delivery of the latter, while when there is an obligation to deliver products at regular intervals from the delivery of the first, the customer has the right to withdraw from the sale.
This withdrawal is without justification and without any charge, and if the item has already been delivered, the customer must return the product exactly in the condition in which it was received, with all its accessories, the forms that accompany it and its packaging in excellent condition. The return of the item is accepted, only if the buyer has first paid any amount incurred by the company for sending the item to him and the shipping costs for the return of the item.
The declaration of withdrawal is made in writing or electronically and GR Mobile is obliged to send confirmation of receipt of the declaration of withdrawal as soon as it reaches it. Following the declaration of withdrawal, GR Mobile is obliged to return the price it received. The refund to the customer will be made in the case of a charge as follows: in case the price has been paid to the COMPANY by the Bank before the withdrawal and return of the item , the COMPANY will be obliged to inform the Bank of the cancellation of the transaction and the bank will carry out any act provided for on the basis of the contract it has drawn up with the customer. Delivery charges are non-refundable and the customer must bear the costs of returning the products. The customer is also obliged (unless the supplier has offered to collect the goods himself) to return the products within 14 calendar days from the day on which he communicated the withdrawal.
The customer is responsible for indemnifying the company if he made use other than that which is necessary to establish the nature, characteristics and operation of the goods in the period until the declaration of withdrawal and the COMPANY is entitled to agree with the customer its compensation even with mutual netting. In the event that the withdrawal concerns the provision of services, the customer must pay an amount proportional to what was provided up to the declaration of withdrawal. If the consumer exercises the right of withdrawal any associated contracts expire automatically, at no cost to the customer.
Exceptions to rescission:
No rescission is permitted in
– Contracts for services after the service has been fully rendered, if performance has begun with the prior express consent of the customer and with the customer’s acknowledgment that the right of rescission will be lost once the contract has been fully performed by the supplier.
– Products which are not suitable for return, for health protection or hygiene reasons, and which have been unsealed after delivery, such as personal care items (epilators, shavers – clippers – clippers, brushes, toothbrushes and thermometers ).
– Contracts in which the consumer has specifically requested a visit from the supplier in order to carry out urgent repairs or to carry out maintenance work. If, in the case of such a visit, the supplier provides services in addition to those specifically requested by the consumer or goods beyond the spare parts that were compulsorily used during the performance of maintenance work or during repairs, the right of withdrawal applies to said additional services or goods
– Sale of sealed audio recordings or sealed video recordings or sealed software for computers – gaming machines (consoles), unsealed after delivery.
